In a significant legal victory, the vessel Marassa Express, valued at approximately $120,000.00, has been successfully forfeited following a recent court decision.
This outcome marks the culmination of a meticulously coordinated effort involving multiple government agencies and legal representation by Dr. Angela Brooks on behalf of The Crown.
The case originates from an intelligence-led operation conducted on West Caicos on February 5th, 2023, during which 90 migrants were encountered. Subsequently, The Crown prosecuted the defendants, Alexis Georgis and Meralien Merlien, in the Magistrate court, resulting in successful convictions.
The defendants were convicted of various charges related to unlawful entry and failure to report to the proper officer.
Alexis Georgis faced fines totaling $13,000 payable within 14 days or imprisonment for up to 18 months, while Meralien Merlien was fined $9,000 payable within 14 days or imprisonment for up to 16 months. Despite an appeal, which was heard last week and decided on April 30th, 2024, the court upheld the sentences imposed on the defendants.
Arlington Musgrove, Minister of Immigration and Border Services, emphasized the broader significance of the forfeiture, stating, "The forfeiture of the Marassa Express is not merely a legal triumph; it stands as a resolute declaration of our commitment to safeguarding our borders and upholding the integrity of our immigration laws."
He further underscored the message to potential violators, asserting that there will be consequences for unlawful exploitation of borders, and justice will be pursued rigorously.
The successful outcome of this case highlights the effective collaboration among various departments within the Turks and Caicos Islands authorities. It serves as a testament to their dedication to enforcing immigration and customs laws, as well as ensuring the safety and security of the Turks and Caicos Islands.
